What Types of Damages Can I Pursue In a Personal Injury Claim?
In California injury cases, the state allows for two types of damages, economic and non-economic.
Economic damages: This refers to tangible expenses that result from your accident or injury that cause you to have to pay money out of pocket. Some of them are as follows:
- Medical bills- past and future
- Medical expenses related to therapy, rehabilitation, medications, or equipment
- Home or vehicle modifications that are needed due to your injury
- Property damage
- Lost wages-past and future
Non-economic damages: These types of losses include damages that result from your accident and are considered to be intangible. Some examples are as follows:
- Pain and suffering
- Loss of enjoyment of life
- Loss of consortium
- Disfigurement
If you have been the victim of an accident caused by negligence, it is imperative that you speak with a personal injury attorney as soon as possible. An experienced attorney can assist you in navigating the complicated laws that surround personal injury claims. We strive to ensure that you understand your rights and legal options.
How Can I File a Wrongful Death Lawsuit?
In California, if one of your immediate family members has been the victim of wrongful death, you may be able to file a claim. However, it should be noted that there are certain stipulations California places on who is eligible to file such claims.
In order to file a wrongful death lawsuit, you must be either a surviving spouse, child, parent, or sibling of the decedent. The right to sue for wrongful death first falls to the surviving spouse, and then if they voluntarily waive their rights, the ability to file a claim would then fall to the children. If there is no spouse or children, the parents can file a claim. Finally, if there is no family other than siblings, they can claim the right to file a wrongful death lawsuit.
It should be noted that there is a statute of limitations placed on the amount of time that you have to file a wrongful death lawsuit. Generally, the law places a two-year time limit on filing a claim. In other words, you have two years from the date that the death occurred to file. There are, however, exceptions to this rule, including when the responsible party leaves the state, or what is known as “delayed discovery” occurs in which the injury that caused the death was not discovered until a later date.
Immediate family members who qualify can file a lawsuit asking for economic and non-economic damages related to their loss that including:
- Funeral expenses
- Medical expenses
- Loss of companionship
- Loss of future income/support
- Pain and suffering experienced by the decedent due to their injury before they died
If you have lost a loved one due to wrongful death, speak with one of our personal injury attorneys. Time is not always on your side in cases such as these.
How Long Does it Take to Settle a Personal Injury Claim?
Each personal injury claim is different due to the unique circumstances and factors that surround each case. Therefore, there is no specific timeline that can be given to determine exactly how long your case may take to be resolved.
Some factors to take into consideration are as follows:
- The extent of the injuries suffered
- The overall complexity of the claim
- The number of parties involved in the case
- The willingness of the responsible parties to reach a settlement
As experienced personal injury attorneys, The Paris Law Firm is committed to answering any questions and concerns that you may have in regard to the time and progress that is being made in your case.
